The Federal High Court in Abuja has nullified the impeachment and subsequent removal of Philip Shuaibu as Edo State Deputy Governor.
In his judgment, Justice James Omotosho, declared that the impeachment process and removal of Shuaibu violated multiple provisions of the Nigerian Constitution and other relevant laws.
The judge emphasised that due process was not followed, rendering the actions taken against Shuaibu unlawful and unconstitutional.
“The impeachment proceedings lacked the requisite adherence to the due process of law as stipulated in the Constitution,” Justice Omotosho stated. “Such violations cannot stand in the face of our judicial system that prides itself on fairness and justice.”
Recall that Philip Shuaibu, a prominent political figure in Edo State, was controversially impeached and removed from his position as deputy governor under circumstances that raised numerous legal and ethical questions.
Allegations of procedural misconduct and political maneuvering surfaced, prompting Shuaibu to challenge his removal in court.
The court’s judgment not only nullifies Shuaibu’s impeachment but also mandates his immediate reinstatement as the deputy governor of Edo State.
This decision effectively restores Shuaibu to his former position, allowing him to resume his duties and responsibilities.
The ruling carries significant implications for the political dynamics in Edo State. It underscores the judiciary’s independence and its crucial role in ensuring that democratic principles are upheld.
The court’s decision has elicited a range of reactions from various stakeholders. Supporters of Shuaibu have hailed the judgment as a victory for democracy and the rule of law. Many see it as a necessary check on political excesses and a reaffirmation of the legal protections afforded to public officials.
“This judgment is a testament to the integrity of our judicial system,” said a spokesperson for Shuaibu. “It restores faith in the idea that justice will prevail, regardless of political pressures.”
On the other hand, opponents of Shuaibu and those who supported his impeachment have expressed disappointment. Some have hinted at potential appeals, indicating that the legal battles might not be over yet.
Legal experts have praised the judgment for its thoroughness and adherence to constitutional principles. They argue that the ruling sets a crucial precedent for the impeachment process in Nigeria, ensuring that such actions are carried out within the bounds of the law.
