The Nigerian Bar Association (NBA) has strongly criticized the Benue State House of Assembly’s decision to remove Chief Judge Justice Maurice Ikpambese over allegations of financial misconduct and abuse of office.
In a statement by NBA President Mazi Adam Osigwe and Secretary Dr. Mobolaji Ojibara, the association described the Assembly’s resolution as “unjustifiable” and a “brazen assault on the Constitution.”
The NBA emphasized that the removal of a judicial officer, especially one occupying the esteemed position of Chief Judge, must adhere strictly to due process as outlined in the Nigerian Constitution. They stated that any deviation from this process is a direct affront to the rule of law and poses a significant threat to democracy.
The association further criticized the Assembly’s action, stating, “It is laughable for the House of Assembly of any State to purport to have the power to discuss, much less recommend, the removal of the Chief Judge of a State without the involvement of the National Judicial Council (NJC).” They reminded all arms of government that respect for constitutional provisions is mandatory, and upholding the rule of law is the bedrock of a just and equitable society.
The NBA called upon all elected officials to desist from arbitrary and unconstitutional actions that jeopardize the sanctity of the judiciary. They also urged law enforcement agencies to ensure that Justice Ikpambese is not prevented from discharging his duties, emphasizing the importance of protecting judicial officers from harassment and intimidation.
In conclusion, the NBA urged the Benue State House of Assembly to immediately rescind its unconstitutional decision and follow the proper channels through the NJC for any grievances or allegations against judicial officers. They stated, “The show of shame must stop.”
Justice Maurice Ikpambese, an indigene of Benue State from Kwande Local Government Area, was appointed a Judge of the Benue State High Court in 2001 and confirmed as the Chief Judge in April 2023.
The Benue State House of Assembly had approved the removal of Justice Ikpambese over allegations of financial impropriety and abuse of office, directing that the next most senior judge be sworn in as acting Chief Judge pending the outcome of an investigation into the allegations.
