Two Chinese nationals, Duan Ya Hong and Xiao have been sentenced to one year imprisonment by the Federal High Court in Ilorin, Kwara State, for illegal mining and possession of solid minerals without the requisite licenses.
According to a statement issued by Dele Oyewale, Head of Media & Publicity at the Economic and Financial Crimes Commission (EFCC), the duo, along with their company, Ebuy Concept Limited, were arraigned on April 22, 2024.
They initially pleaded not guilty to the charges. However, on May 14, 2024, they chose to plead guilty to one count of the amended 11-count charge.
The prosecution, led by Innocent Mbachie, presented the facts of the case and submitted evidence, including the defendants’ extra-judicial statements, photographs, and forensic reports.
The defense, represented by I.A. Ahmed, did not object to the admission of these exhibits.
Justice Evelyn Anyadike ruled that the prosecution had proved its case beyond reasonable doubt.
Hong was sentenced to one year in prison with an option of a N2 million fine, while Yi received a similar sentence with an option of a N1.5 million fine.
The court also ordered the interim forfeiture of 30 tons of minerals and the truck used to transport them.
This conviction and sentency highlight the Federal High Court’s commitment to combating environmental and economic crimes.
It will serve as stern warning to individuals and companies involved in illegal mining activitiesc in Nigeria.
