52-Yr-Old docked over alleged N200,000 fraud

A 52-year-old man, Oguntolu Joshua ,was on Thursday arraigned before Magistrate AI Sanomi of an Osogbo Chief Magistrates’ Court, in Osun, for alleged fraud of N200,000.
Joshua is facing a two-count charge bothering on fraud and deceit that were levelled against him.

The prosecutor, Insp. Irewole Jimoh, told the court that the accused committed the offences on July 5, 2011 at about 1:55 p.m., at New Town Avenue area, Ipetu-Modu in Osun.

Jimoh said the accused deceitfully and fraudulently, obtained the sum of N200,000 from one Oladoye Sunday, under the pretext that he would supply him with an Ice-Block-Making Machine.

Jimoh said that the accused knew that the promise was a false.

He said that the accused had been on the run before he was arrested by the police that brought him to court.

The prosecutor said that the offences contravened Sections 419 and 383, punishable under Section 390(9) of the Criminal Code, Cap. 34 Vol. 11, Laws of Osun, 2003.

The accused pleaded not guilty to the charges preferred against him.
The defence counsel, Mr Martins Awe, prayed the court to grant his client bail in the most liberal terms.

The magistrate, Mrs AI Sanomi, granted the accused bail in the sum of N100,000 with two sureties in like sum.

Sanomi said that the sureties must be residing within the court’s jurisdiction.

They must also show evidence of tax payments and produced three-passport-sized photographs attached with an affidavit of means.

She added that one of the sureties must be a land owner and be willing to drop its original documents.

Sanomi added that the other surety must be a closed relation of the accused.

The magistrate then adjourned the case until Feb. 6 for hearing.
